Thomas W. Evans
Tom Evans represents business in commercial litigation and retailers and restaurant companies in zoning and permitting matters.
Since 1988, Tom has litigated complex real estate and business cases in Federal and state courts, including land use cases, breach of contract disputes, securities fraud cases, defense of defamation cases, breach of fiduciary duty cases and employment matters. He has brought and defended class action claims.
He represents national and international retail businesses and restaurant companies in the areas of land use, zoning, permitting, site development and redevelopment, lease and contract negotiations, obtaining approvals, appearing before local boards and pursuing appeals in courts.
He also represents businesses in matters involving Massachusetts sales and use tax and in obtaining tax benefits as a result of being designated as manufacturing corporations by the Massachusetts Department of Revenue.
After graduating from Harvard College and New York University School of Law, Tom joined the Boston office of Brown, Rudnick. From 1996 to 2007 he practiced at Cohen & Fierman.
His litigation successes include:
- Successfully defending a European insurance company in a series of class action securities fraud cases;
- Successfully defending a European high tech company in a case concerning application of a noncompete agreement to a recently hired executive;
- Obtaining a judgment for specific performance of a purchase and sale agreement for two water view lots on Cape Cod;
- Representing a plaintiff in major construction defects litigation resulting in substantial settlements and judgments against multiple defendants.
- Representing a Fortune 100 company in a successful appeal of an Appellate Tax Board decision.
- After a trial in Massachusetts Superior Court, obtaining a substantial judgment, including double damages and attorneys’ fees for a major national retailer.
- Litigating and then obtaining a very favorable settlement for a national restaurant chain in a lawsuit brought by a publicly traded real estate company.
Tom is admitted to practice in the Commonwealth of Massachusetts, the Federal Court for the District of Massachusetts and in the State of Rhode Island.
